A Golden Opportunity In California to Double Dip on Overlapping Homebuyer Tax Credits

Thank you Janet for a concise summary of the overlapping tax credits....

Via Janet Guilbault California Mortgage Banker/Broker:

If EVER there was a reason to get off the fence and BUY YOUR HOUSE in California, this is it. We're talking a once in a lifetime, 24 karat golden opportunity to have the government subsidize your home purchase for up to $18000 in tax credits.

But the window of opportunity is EVER so brief if you are going to attempt to double dip and get both the state and the federal tax credits.

Here's how the double dip works: The federal home buyer tax credit for first time buyers states you must be in contract to buy your house by April 30th and close before June 30th to be eligible for the credit.

But a newly enacted California stimulus for home buyers actually OVERLAPS the federal first time home buyer tax credit!

You can also receive $10,000 in tax credits as a first time buyer, from the State of California for transactions that CLOSE after May 1.

If you have followed me so far (and there are 18,000 reasons to pay attention and follow) you have probably figured this out:

  1. By being in a RATIFIED CONTRACT before April 30, you can qualify for the $8000 first time homebuyer tax credit from the Federal government (as long as it closes by June 30)
  2. By CLOSING that RATIFIED CONTRACT after May 1, you can qualify for the $10,000 first time homebuyer tax credit from the State of California.

ADVICE:

Already in contract and set to close at the end of April? A delay of close until May 3 will not endear you to your Realtor or to your seller, but could qualify you for $10,000 in tax goodies (May 1 and 2 are a weekend).

If you are NOT already in a contract, you are going to need to contact a mortgage professional and get thoroughly pre-approved NOW. Make sure closing the loan before June 30th will be possible based on your situation. (60 days is NOT unreasonable for most loans).

Once preapproved, seek out a great Realtor who knows the ropes, will work FAST, and will work as a team with your chosen mortgage professsional.

Disclaimers: As a mortgage professional, I am not qualified to give tax advice. Please consult your tax advisor. Be aware there are income limitations on the federal tax return, and there could be other factors that limit your ability to receive the tax credits.

For more information, a speedy preapproval, or a referral to a great Realtor, call me at 925-552-3867.

Where is Clayton, California?

I noticed that someone typed a Google search that asked "Where is Clayton, California?"  Since I live in Clayton, California - and believe wholeheartedly that it is the BEST place imaginable - I am going to answer that question.

Clayton California sign

Clayton California is located in Contra Costa county of northern California.  Contra Costa and Alameda counties are commonly referred to as "East Bay" because it is across the Bay from San Francisco.  If fact, if you start in San Francisco, you would take Bay Area Rapid Transit (BART) for 36 minutes to the city of Walnut Creek.  From Walnut Creek, drive 7 miles east to Clayton.  For a good visual, check out this Google Map.

Clayton is the perfect place to live.  Although only a stone's throw from major metropolitan areas, it is a community-oriented city surrounded by beautiful hills, well-planned open spaces, located at the base of Mt. Diablo State Park, and comes with a huge bonus - the lowest crime rate in the nine Bay Area counties.

Clayton Walking Trail

In addition to that (as if it wasn't enough), Clayton received Walking Magazine's award as one of the five Most Walkable Cities in America and made CNN Money's 2009 list of the Top 100 Places to Live.

If you need a few demographics to be convinced, I will supply them. Depending on the source, the average Clayton income ranges from $108,000 to $121,200 and greater than 50% of the residents have an Associates, Bachelors or Graduate degree.  Over 82% of the of homes in Clayton are family (non-single) occupied.

Clayton is a paradox.  It's close to the city and is the home of professionals but feels like the best of a small town.  There is something about Clayton that pulls you to participate in the community. While other small cities are struggling with the state's drain on municipal dollars, Clayton's volunteers and civic groups remain a great resource.

Think you might want to move to Clayton?  Give me a call or send me an e-mail to schedule a tour.  Too far away for the personal touch?  Take a visual tour of Clayton.

Smart Home Buying - Sewer Lateral Inspection

One inspection that home buyers often choose to waive - and shouldn't - is the Sewer Lateral Inspection

Why is a Sewer Lateral Inspection important?  A homeowner is responsible for the maintenance of the sewer lateral (the sewer line) from their home to the sewer main at the center of the street.  This can be a very expensive repair.

The sewer lines in many Contra Costa County cities (including Alamo, Concord, Clayton, Lafayette, Martinez, Moraga, Orinda, Pleasant Hill and Walnut Creek) are made of clay and are reaching the end of their intended useful life.  Some additional problems include:

Sewer pipe with tree roots

Clay pipes are not sealed at the joints allowing the tree and bush roots to infiltrate the line and block the flow of the sewer pipe. The photo to the left shows a sewer that is more than 60% blocked with roots.

A healthy tree growing over the sewer line is likely getting the richest of fertilizer!

Collapsed Sewer

In many cases, drought conditions have contracted the ground surrounding the sewer pipe causing it to break or collapse, shown in the photo to the right.

Photos provided courtesy of PipeCam Inc. whose inspection process includes a video of the entire sewer lateral and a supporting written report.  They are "In The Know About What's Below".

Here are some common reasons to inspect the sewer line during your inspection contingency timeframe:

  1. The home was built on or before the early 1970's
  2. Mature trees or bushes in front or on the side of the property
  3. Cracked or raised concrete
  4. The home has been vacant for a period of time
  5. The buyers have a greater number of occupants than currently occupy the home or will entertain large groups at their home.
  6. The seller has disclosed past sewer problems or maintenance
  7. $250 is cheap compared to a surprise sewer repair!

Additional items to review during your inspection contingency timeframe:

Short-Sale and Foreclosure Advice: Urban Legends versus FACTS

I have received dozens of phone calls from California home owners as a result of my post Clarification Regarding California Non-Recourse mortgages.

Based on these phone conversations, I have come to the conclusion that there is a very frightening trend:  real estate professionals (both loan officers and real estate agents) are offering advice based on "real estate urban legends" i.e. information that has been passed from person to person and is treated FACT but is completely unsubstantiated.

Three examples of these calls are:

A homeowner has lost 60% of the value on his investment property which has negative cash flow.  The mortgages (a 1st and 2nd) were refinanced so they are no longer non-recourse.  He doesn't have a hardship situation.  His loan officer told him to to stop making the payments and let the home go to foreclosure to get out from under the mortgage debt.  Urban legend advice.  Foreclosure will release him from the obligation to repay on the 1st mortgage only (assumed to be the foreclosing lender) but the 2nd lienholder will have the right to collect a whopping $180k for up to four years - and they are pursuing these collections.

A homeowner with a valid hardship is selling his home as a short-sale.  The home had been refinanced multiple times with some level of cash-out each time.  His real estate agent told him not to worry about income taxes on the deficiency because "there is a federal law that says he doesn't have to pay".  Again, urban legend advice.  The Mortgage Forgiveness Debt Relief Act very clearly states that income taxes don't have to be paid on the "acquisition indebtedness" for a primary home.  Income taxes DO have to be paid for the unpaid balance above the original purchase mortgage.  In this case, the amount of phantom income will be over $250k.

Another homeowner with a short-sale.  The approval clearly states that the 2nd lienholder retains their right to collect the balance due.  The real estate agent told him not to worry about it.  If the lender tries to collect, he can always file bankruptcy.  Urban legend advice.  In California, you must pass a "means test" to file a Chapter 7 bankruptcy if you earn in excess of approx. $75k per year.  Most people will not pass the means test without their mortgage and will be forced in to a Chapter 13 bankruptcy (repayment plan).

To be treated as professionals, we must act as professionals.  Due dilligence and research on the information we offer as fact should be the bare minimum standard of conduct.  Equally important, clients making these crucial decisions should be emphatically urged to consult with the appropriate legal and tax professionals or the financial repurcussions could be devasting.
